Portway, Bristol fly-tipping leads to five-year Asbo

MR PILE left a pile of rubbish behind him beside the Portway, one of Bristol’s most picturesque routes.
For his efforts, the 42-year-old man has been fined £1,000 and given a five-year Asbo. He was also ordered to pay costs of £808.97.
At Bristol Magistrates Court yesterday, Daniel Pile, of Broadleas, Headley Park, Bristol, pleaded guilty to six counts related to the carrying and dumping of commercial waste near the old Bristol and West sportsground.
He asked for two other offences of fly-tipping and 57 of carrying waste without a licence to be taken into consideration.
The court was told that on 20th October 2009, Pile asked Paul King, who was carrying out building work in Bedminster, if he could take away some scrap metal. He told Mr King he was using a private tip. The next day, it was agreed that Pile could remove around three-quarters of a tonne of railings and racking. He removed more material in the following days.
Pile was paid a total of £400 for taking away four loads of waste. In November 2009, he removed more commercial waste from East Street, Bedminster – for £250.
Bristol City Council enforcement officer Shaun Pine noticed that rubbish had been dumped at the side of the A4 Portway, near the inbound carriageway. In a search of the material, he found evidence linking it to Albermale and Bond, a property owned by Paul King’s boss Paul Morris.
Mr King showed the enforcement officer Pile’s receipts and Pile was arrested at his home in Bristol.
Prosecutor Kate Burnham said fly-tipping was a major problem in Bristol. The maximum sentence was a fine of £50,000 or a year in jail. It was a crime to transport commercial waste without a licence, she added.
Pile said he regretted what he had done and had now obtained a commercial-waste licence. He added: “I don’t ever intend to fly-tip or break the law in this way again.”
“I found myself in a difficult situation last year financially. I had just come out of developing flats and I had massive debts. I do regret doing it and I regret the shame I’ve brought to my family.”
Since getting his licence, Pile has cleared the rubbish he dumped and disposed of it properly.
